This Privacy Policy sets forth policies and procedures regarding your use of the services, data, software, applications, contract templates, website, and tools (collectively “Services”) provided by Happy Valley Talent.com, a joint venture of The Chamber of Business & Industry of Centre County (CBICC) and The Happy Valley Adventure Bureau (HVAB) (collectively, “We”, “Us”, or “Our”), including, without limitation, regarding what information we collect about you in accordance with your use of and access to the Services, and how that information is used, stored, shared, and/or deleted.


Your use of the Services and any information you may provide is subject to the terms of this Privacy Policy, as may be updated from time to time. This Privacy Policy does not apply to any third-party website, services, or applications, even if such are available or accessible through the Services. This Privacy Policy is incorporated by reference into the relevant Terms and Conditions (the “Terms”), which govern your use of and access to the Services.


By using the Services, you acknowledge that you have read, understood, and agreed to be bound by the terms contained in this Privacy Policy.


Information We Collect

The types of information we may collect and our privacy practices are dependent on your interaction with the Services and requirements of applicable law. Through your use of the Services, we may collect the following information:


User Provided Information – We may collect certain personal information in order for you to use the Services, including, without limitation, (i) name; (ii) mobile phone number; and/or (iii) email address. Additionally, when you send a communication via the Services, we may also collect that communication and any information you choose to provide therewith, and you agree we are free to use the content of any communications submitted by you for any purpose.

Information you share for use of the Services is shared at your own risk.


By using the Services you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Services, sending you an email, or sending you a text message.


Retention of Your Information

We will retain the personal information you provide through the Services so long as you are an active user of the Services, and thereafter so long as needed for purposes that are not prohibited by applicable law. 

Privacy Rights of Minors

The Services are not intended for use by anyone under the age of 18, and we do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a child under the age of 18, we will take steps to delete such information from our files as soon as possible.

We reserve the right to modify this Privacy Policy at any time. Changes and clarifications will take effect immediately upon their posting on the Services. If we make material changes to this policy, we will attempt to notify you. Your continued use of the Services constitutes your agreement to this Privacy Policy and any future revisions, updates, or modifications.


Governing Law

This Privacy Policy shall be deemed made in the Commonwealth of Pennsylvania and shall be construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania without regard to any conflict of law provisions. 

By using the Services, you agree that all disputes, claims, or causes of action arising from or related to your use of the Services will be resolved through binding arbitration in Centre County, Pennsylvania in accordance with the rules of the American Arbitration Association. 

Nothing in this Section shall prevent us from seeking injunctive or other equitable relief from the courts for matters related to data security, or unauthorized access to the Services.


General Information

This Privacy Policy sets forth the entire understanding between you and us regarding your use of the Services. In the event any one or more of the terms and conditions contained in this Privacy Policy is held to be invalid, illegal or unenforceable, the remaining provisions will not in any way be affected or impaired thereby. Our failure to insist upon strict adherence to any term contained in this Privacy Policy shall not constitute a waiver of such term and shall not be considered a waiver or limit of any right thereafter to insist upon strict adherence to that term or any other term contained in this Privacy Policy.
